Proof of Claim Submission

If you are a Settlement Class Member and wish to be potentially eligible for a payment from the proceeds of the Settlement, you must complete and submit a Proof of Claim and Release form ("Proof of Claim"). To obtain a copy of the Proof of Claim, click here. The deadline to submit a timely Proof of Claim is September 20, 2017.

You may submit your Proof of Claim using one of two methods. Each method is described below, with links to the requirements for each submission. Your submitted Proof of Claim will also constitute full acknowledgement and complete satisfaction of, and full, final, and forever settlement, release, and discharge from the Released Claims each and all of the “Released Parties,” defined as (i) Defendants, (ii) the Fortis Defendants, (iii) any and all of their past, present and future family members, spouses, parent entities, associates, affiliates, subsidiaries, predecessors, successors and/or assigns, and (iv) the past, present and future officers, directors, executives, partners, stockholders, representatives, employees, attorneys, financial or investment advisors, underwriters, consultants, accountants, auditors, investment bankers, commercial bankers, brokers, dealers, lenders, insurers, co-insurers, reinsurers, advisors, agents, fiduciaries, heirs, executors, beneficiaries, distributees, foundations, trusts, trustees, general or limited partners or partnerships, joint ventures, limited liability companies, corporations, member firms, divisions, associated entities, principals, managing directors, members, managers, entities providing any fairness opinion, personal representatives, estates, administrators, predecessors, predecessors in interest, successors, successors in interest, assigns and/or any other representatives of each of the foregoing.

Whichever submission method you choose, please note that supporting documentation of the transactions and holdings listed on your Proof of Claim is required. Include all required and necessary documentation with your submission. In the event that you submit your Proof of Claim online, you must retain confirmation of such filing, which is provided at the end of the filing process.

If you fail to execute and submit a timely, properly completed and addressed Proof of Claim, your claim may be rejected and you may be precluded from any recovery from the Net Settlement Fund.

Submit Your Proof of Claim by Mail

To submit a Proof of Claim by mail, complete and sign the Proof of Claim in its entirety with all required supporting documentation and mail it, postmarked no later than September 20, 2017, to the Claims Administrator at:
